The adult guardianship system, which has been in effect since July 1, 2013, allows individuals to aid those who lack the ability to handle affairs due to mental constraints caused by diseases, disabilities, old age, and other reasons, while maintaining personal dignity. The previous system had excessively restricted the autonomy of adults with insufficient judgment ability, removing their ability to act and preventing them from acting legally even if they had residual ability. Many appointed guardians did not fully perform guardianship functions for the elderly or the disabled, instead focusing on their own property management.
The new adult guardianship system is significant in terms of respect for personality compared to the previous system. It is based on the idea of abandoning the conventional approach of completely or restrictively excluding oneself from the category of persons capable of acting, establishing a protection support system for the ward and fully respecting and utilizing the remaining ability of the person, while respecting the right to self-determination as much as possible. In his talk, Mr. Kim will explain how to apply for an adult guardianship trial to the court if we need guardianship, and what roles and duties of the court and guardians have since the guardian was appointed.
